432PLAYER END USER LICENSE AGREEMENT AND TERMS OF USE

THIS END USER LICENSE AGREEMENT AND TERMS OF USE ("AGREEMENT") IS A LEGAL CONTRACT BETWEEN YOU AND APPUM STUDIOS, LTD. ("APPUM STUDIOS," "WE," "US," OR "OUR"). BY INSTALLING, ACCESSING, OR USING ANY VERSION OF THE 432PLAYER SERVICES, INCLUDING BUT NOT LIMITED TO THE 432PLAYER MOBILE APPS, 432PLAYER RADIO APP, DESKTOP APP, BROWSER EXTENSIONS, OR ANY OTHER SOFTWARE OR WEB-BASED SERVICE (COLLECTIVELY, THE "SERVICE"), YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE THE SERVICE.

1. OVERVIEW

432Player is an information-location tool and music playback platform that allows users to listen to locally stored music and publicly available internet radio stations. The radio content is accessed through third-party sources indexed by the publicly accessible Radio-Browser API. All radio content is owned and operated by external broadcasters, and Appum Studios does not host, control, or claim rights to any such content.

All 432Player-branded products and services, including the standard music player apps and the 432Player Radio App, are owned and operated exclusively by Appum Studios, LTD.

2. ACCEPTANCE OF TERMS

By using the Service, you agree to comply with this Agreement and all applicable laws and regulations. You must be at least 13 years of age to use the Service. If you are under 18, you must have your parent or guardian’s consent to use the Service.

3. LICENSE GRANT

Appum Studios grants you a limited, non-exclusive, non-transferable, revocable license to download and use the Service on your personal devices for non-commercial use only. You may not:

Modify or copy the Service or any materials.
Use the Service for commercial or public display.
Reverse engineer, decompile, or disassemble any software.
Remove any copyright or proprietary notices.
Use the Service in any manner that violates applicable law.

This license will automatically terminate if you violate any provision of this Agreement.

4. INTELLECTUAL PROPERTY

All intellectual property related to the Service (including but not limited to trademarks, software, and logos) is owned by Appum Studios or its licensors. Radio station names, logos, and content remain the property of their respective owners.

Use of any third-party content does not imply affiliation or endorsement. Any radio station may request removal by contacting us at contact@appums.com.

5. USER RESPONSIBILITIES

You are responsible for your account and activity on the Service. You agree not to:

Harass or impersonate others.
Upload viruses or malicious code.
Interfere with network security.
Attempt unauthorized access to systems.

You agree to comply with all applicable laws and to use the Service responsibly.

6. THIRD-PARTY PLATFORMS

The Service may be made available through third-party platforms and services including but not limited to the Google Play Store, Apple App Store, Google Chrome, Heroku, and Netlify. Appum Studios does not control these third-party platforms and is not responsible for their terms, functionality, or availability. If any third-party platform chooses to remove or restrict access to the Service, Appum Studios is not liable for any resulting interruption or termination. In such cases, no refunds will be issued, but we may assist with canceling any ongoing subscriptions if needed.

7. MODIFICATIONS TO SERVICE

Appum Studios may change, update, suspend, or discontinue any part of the Service at its discretion without notice. We may also update this Agreement at any time. Your continued use of the Service after any changes constitutes acceptance of the revised terms.

8. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." APPUM STUDIOS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. LIMITATION OF LIABILITY

IN NO EVENT SHALL APPUM STUDIOS OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR PROFITS, ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE.

10. FEEDBACK

If you provide feedback or suggestions to Appum Studios regarding the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and incorporate that feedback without restriction or obligation to compensate you.

11. EXPORT CONTROL

You agree to comply with all applicable export laws and regulations. You will not export, re-export, or transfer the Service to restricted countries or individuals without proper authorization from the relevant government authorities.

12. TERMINATION

We may terminate or suspend your access to the Service at any time for any reason, including violation of this Agreement. Upon termination, you must cease all use and destroy any downloaded materials.

13. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of Israel, without regard to its conflict of law principles. Any legal proceedings shall take place in the courts of Israel.
